Restricted Building Work

Restricted Building Work (RBW) has come into effect since 1 March 2012.

What

Is your residential work “Restricted Building Work”

If your residential building work is structural or if it affects the weathertightness of the building, the work may be “Restricted Building Work”. This means you MUST employ a Licensed Building Practitioner(s) (LBP) to design and carry out that work. They must either DO or SUPERVISE this work.
Who

Licensed Building Practitioners (LBPs) are here right now

They include designers, carpenters, roofers, external plasterers, bricklayers, site and foundations licensed in the Government’s LBP scheme.

Registered architects and chartered professional engineers are automatically treated as Design LBPs. Licensed or certified plumbers or gasfitters are automatically treated as licensed in Brick and Blocklaying, External Plastering and Roofing. They are treated as LBPs in these classes but must only complete Restricted Building Work that they have the competency to do.

Code Compliance Certificates (CCCs)

A code compliance certificate is a formal statement, under section 95 of the Building Act 2004, that building work carried out under a building consent application complies with that building consent. The owner must apply for a code compliance certificate after all work set out in the building consent has been completed.

Building owners whose projects received a building consent after 31 March 2005 must apply for a code compliance certificate as soon as the building work is complete. Compliance will be measured and issued against the building consent. If an owner does not apply within two years after receiving the consent, the building consent authority must decide whether to issue the code compliance certificate. The building consent authority and the owner can agree to extend the timeframe.

If you began a building project under the old Building Act (1991) and your building consent was issued prior to 31 March 2005, then special provisions will apply when you come to get the work signed off at the end of the project. You should apply for a code compliance certificate as soon as possible after completing the building work. These projects will not be subject to the two-year timeframe and will be assessed against the Building Code in place when the building consent was issued.

Relocating a Building

A Building Consent is required when you are looking to relocate a building onto a new property or change the location of its current site.

Council needs details of the termination of all services on the old site and any demolition or site works that may be required to move the building.

Earthquake-Prone, Dangerous and Insanitary Buildings Policy

Overview

The Timaru District Council is required under Section 131 of the Building Act 2004 to adopt a policy on earthquake-prone, dangerous and insanitary buildings. The purpose of the policy is to reduce the level of risk to people from buildings considered to be earthquake-prone, dangerous or insanitary.
